What are your obligations?
If you are an Architect, Engineer or Building Design Professional who works on the technical design of buildings you have an obligation under Section 22 of the WHS Act to ensure "so far as is reasonably practicable, that the plant, substance or structure is designed to be without risks to the health and safety of persons".
Many times when asked to specify access and fall protection systems, designers use this standard clause "Provide compliant roof safety system to Australian Standards". Would you be interested to know that this clause may not protect you if an injury or fatality should occur on a building you have designed? Read our article: Don't assume you're covered for more information.
In light of the new Workplace Manslaughter laws, in place in many states and to come into effect in Victoria on 1 July 2020, there is even more onus on designers to ensure that they are including in their designs an effective and safe means of access to plant, machinery, facades and other areas for maintenance personnel.
